Can I prevent my doctor from reporting a procedure to my insurance company?
If you pay out-of-pocket for your medical treatment, a medical service, prescription, etc., HITECH (2009 federal law) gave us each the right to prevent that information from being disclosed to our health plans.
It’s true that this right means only those wealthy enough to pay for medical treatment out-of-pocket can protect some personal health data from flowing to health plans.
The idea was that if this right applies only to wealthy people, everyone else could sue for equal treatment/equal protection under the Constitution—everyone in the US is entitled to the same rights, regardless of how wealthy they are.
